01Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of the website at custosa.com and its content (the "Site"), operated by Custosa Inc. ("Custosa", "we", "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
02The Site is informational; the service is separate
The Site provides general information about Custosa and its products. Access to and use of the Custosa service (the runtime data-control plane and related software) is not granted by these Terms and is governed by a separate written agreement between Custosa and the customer. Nothing on the Site is an offer to contract, a commitment to provide the service, or a binding representation of features, availability, performance, or timelines.
03Eligibility & authority
You may use the Site only if you can form a binding contract with Custosa and are not barred from doing so under applicable law. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
04Acceptable use
You agree not to:
- use the Site in violation of any applicable law;
- attempt to gain unauthorized access to the Site or its related systems, or probe, scan, or test their vulnerability or breach security or authentication measures;
- interfere with or disrupt the Site;
- scrape, harvest, or collect data from the Site by automated means except as permitted by our published robots directives;
- reverse engineer or attempt to derive source code from the Site, except to the extent that restriction is prohibited by law; or
- use the Site to transmit malware or other harmful code.
05Intellectual property
The Site and its contents, including text, graphics, logos, the "Custosa" name and marks, design, and code, are owned by Custosa or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your internal, informational purposes. No other rights are granted. You may not copy, modify, distribute, or create derivative works from the Site without our prior written permission.

To the fullest extent permitted by law, our total liability for all claims relating to the Site will not exceed one hundred U.S. dollars (US$100). 10Indemnification
You agree to indemnify and hold harmless Custosa from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Site or your violation of these Terms or applicable law.
11Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to the Site or these Terms, and you consent to personal jurisdiction there.
12Changes to these terms
We may modify these Terms from time to time. Changes are effective when posted, and we will update the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance.
